End User License Agreement for Apple App Store

Cubeot is licensed, not sold, to you for use on Apple-branded devices. This agreement supplements Apple’s standard licensed application terms and the Cubeot Terms of Service and Privacy Policy.

1. Scope of licence

You receive a limited, non-transferable licence to use Cubeot on Apple-branded products that you own or control, as permitted by the Apple Media Services Terms and Conditions, including Family Sharing where available.

2. Apple is not a party

This agreement is between you and Linkhead Future Technology Co., Ltd., not Apple. Apple is not responsible for Cubeot or its content.

3. Maintenance and support

Linkhead Future Technology Co., Ltd. is responsible for maintenance and support for Cubeot. Apple has no obligation to provide maintenance or support services.

4. Warranty

Linkhead Future Technology Co., Ltd. is responsible for any product warranties to the extent not effectively disclaimed. If Cubeot fails to conform to an applicable warranty, you may notify Apple and Apple will refund the purchase price, if any. To the maximum extent permitted by law, Apple has no other warranty obligation.

5. Product claims

Linkhead Future Technology Co., Ltd., not Apple, is responsible for addressing claims relating to Cubeot, including product-liability, legal or regulatory compliance and consumer-protection claims.

6. Intellectual-property claims

If a third party claims that Cubeot infringes intellectual-property rights, Linkhead Future Technology Co., Ltd., not Apple, is responsible for the investigation, defence, settlement and discharge of the claim.

7. Third-party beneficiary

Apple and its subsidiaries are third-party beneficiaries of this agreement and may enforce it against you after your acceptance.

8. Legal compliance

You represent that you are not located in a country subject to a U.S. Government embargo and are not listed on any U.S. Government list of prohibited or restricted parties.

Relationship with Cubeot terms. This agreement supplements the Cubeot Terms of Service for users who obtain Cubeot through the Apple App Store. If this agreement and the Cubeot Terms address the same Apple App Store licensing matter differently, this agreement applies to that matter to the extent permitted by law.

Privacy. Personal information processed through Cubeot is handled according to the Cubeot Privacy Policy and related privacy notices. Apple is not responsible for Cubeot’s privacy practices.
